1. The Hire Agreement

These terms govern the hire of event equipment from RED ADMIRAL RENTALS LIMITED by the person or organisation named on the booking confirmation. They apply from the moment a booking is confirmed until every item has been returned, counted and the account settled.

A hire agreement is formed when we issue a written confirmation accepting your booking. The confirmation, the quote, the counted kit list and these terms together form the agreement. If there is a conflict between documents, the booking confirmation takes priority, then the quote, then these terms.

By confirming a booking you confirm that you have authority to bind the person or organisation named, that the information you have given about the site is accurate, and that you accept these terms. If you book on behalf of a company, charity or community group, you also confirm that the organisation will meet the obligations in this agreement.

Please read these terms before confirming. If anything is unclear, contact the hire desk at bookings@redadmiralrentals.hair or on +13093326405 and we will explain it before the booking is placed.

2. Who We Are

The business supplying the equipment is RED ADMIRAL RENTALS LIMITED, operating from Clint Mill, Cornmarket, Penrith - CA11 7HW, United Kingdom (GB). Our contact email is bookings@redadmiralrentals.hair and our telephone number is +13093326405.

We hire marquees, trestle and chair sets, festival stage kits, heater and light packs, wedding package builds and delivery and strike runs. The description of what is included in each service is set out on the services page of this website and in the quote issued for your booking.

Written correspondence about a booking should be sent to the email address above so that there is a clear record. Notices about cancellation, damage or a dispute must be in writing to be effective under this agreement.

3. Quotes and Confirmation

A quote is valid for fourteen days unless it states otherwise. A quote does not reserve equipment. Dates are held only when you confirm in writing and, where we ask for one, when the deposit has cleared.

Quotes are based on the information you provide about the site, the ground, the access and the expected use. If those facts change, the quote may change. We will tell you in writing if a change affects the price, the crew size or the time needed for the run, and we will not add a charge without your agreement except where this agreement allows it.

A confirmation email states the date, the delivery and collection windows, the items hired and the total price. Check it carefully. If something in the confirmation does not match what you asked for, tell us before the run is planned so that the correction can be made.

4. Prices and Charges

Hire prices are stated in the quote and are based on the hire period shown. A weekend hire usually runs from a Friday delivery to a Monday collection. Longer periods are priced separately. Prices include the counted kit, routine cleaning and the checks carried out at the yard before loading.

Delivery, collection, assembly, site visits and any consumables are charged as separate items where they are not included in the quote. Additional charges apply where a run takes longer than planned because of a change you request, where a site is not ready at the agreed time, or where equipment must be collected on a date outside the agreed window.

Prices may be subject to value added tax where the law requires it, and the quote will show the tax position clearly. Invoices are payable within the period stated, which is normally seven days from the invoice date unless agreed otherwise. Late payment may attract interest at the statutory rate together with reasonable recovery costs.

5. Deposit and Security

We may ask for a deposit to hold a date or to secure the return of equipment. The amount is shown in the quote or the confirmation. A date is not held until any requested deposit has cleared.

A security sum may be retained where equipment is returned late, damaged beyond fair wear, lost or not returned at all. We will provide a written breakdown of any deduction and any evidence we rely on, such as a bench report, a tag count or photographs of the item before it left the yard.

Where the value of a loss or repair exceeds the security sum, the balance is charged to the account in the usual way. Where the sum exceeds the amount due, the remainder is returned to the account used for payment within a reasonable period after the final count.

6. Cancellation and Changes

You may cancel a booking by written notice to the contact email. If you cancel more than thirty days before the delivery date, any deposit paid is returned in full less any cost already incurred for a site visit or a special order. If you cancel between thirty and seven days before delivery, the deposit is retained as a contribution to lost hire.

Cancellation within seven days of delivery, or after loading has begun, is charged at a proportion of the hire price that reflects the work already done and the chance of re-letting the equipment. Where the equipment is already on site, the full hire price and the collection cost remain due.

Changes to the kit list or the date are welcome where the diary and the racks allow. Requests made close to the run may incur a charge for re-counting, re-loading or a second vehicle. We will always tell you the cost of a change before doing the work.

7. Delivery and Collection

Delivery and collection take place within the windows stated in the confirmation. Someone authorised to receive the equipment must be present, or access must be arranged as agreed in writing. If no one is available and the crew cannot place the equipment safely, the run may be treated as a failed delivery and a further charge may apply.

The crew will position equipment in a safe and practical place at the site. Where you ask for it to be moved after positioning, a further charge may apply. Equipment must be packed and ready for collection at the agreed time. Where it is not ready, waiting time and a return run may be charged.

On collection the crew counts against the tag and inspects the equipment where the light and the conditions allow. A detailed inspection may take place later at the yard, and any defect found there will be reported in writing with the counter-evidence held on file.

8. Site Conditions and Access

You are responsible for making sure the site is suitable for the equipment and reachable by the vehicle stated in the quote. This includes the approach road, gate widths, turning space, parking near the pitch, overhead cables, underground services and any permission needed from a landowner or local authority.

Marquees and stages require ground that can carry the load and anchors that hold in the surface. You must tell us about soft pasture, made ground, drainage runs, buried cables, heating pipes or services that could be damaged by stakes. Where a site visit has not taken place, you accept the risk of conditions that were not disclosed.

You are responsible for obtaining any planning permission, landowner consent or event licence required for the hire. We can provide information about the dimensions and weights of our equipment to support an application, but the authority remains with you or the venue.

9. Erection and Rigging

Where erection is included in the quote, our crew will erect the equipment in accordance with the manufacturer guidance and the conditions on the day. The location and orientation are agreed with you on site. Once erected, the equipment must not be moved, altered or extended without our written agreement.

Where you choose to collect equipment and erect it yourself, you are responsible for assembly and for following the instructions supplied. Self-erected marquees and stages must be anchored to the standard described in those instructions. If a member of our team finds an unsafe assembly, we may decline to collect it until it is made safe and may charge for the additional visit.

Walls, roofs, guard rails and steps are not to be climbed, hung from or used as anchor points unless a specific instruction says so. Loads on lighting points must not exceed the limits written on the equipment or supplied in the pack notes.

10. Use of Equipment

Equipment is hired for normal event use by the named hirer and the guests or contractors working under that hirer. It must not be sub-let, sold, pledged or moved to another site without our written agreement. Hire equipment remains our property at all times.

Trestles, chairs, decks and rails have load limits and intended uses. Standing on tables, stacking chairs beyond the recommended number, or using stage decks as ramps can cause injury and damage and falls outside the hire. Equipment must not be used for cooking, open fires, welding, spray painting or any purpose that leaves residue or heat damage.

You must keep equipment secure when it is not in use and return it in the condition it arrived, allowing for fair wear. Any fault, missing part or failure noticed during the hire must be reported to us promptly so that we can advise or replace the item.

11. Power, Heat and Lighting

Heater and light packs must be connected to a supply that is safe, correctly rated and protected. Cables must be routed so that they do not cross walkways, stand in water or run under doors that could trap them. Plugs and sockets must be kept dry at all times.

Heaters must not be placed against walls, covers or soft furnishings, and nothing must be draped over a heater or a lamp. Where a fuel heater is supplied, refuelling takes place outdoors and only while the unit is switched off and cool. Ventilation must be maintained in enclosed spaces.

If a supply trips or a light pack fails, switch off at the supply and contact us. Do not open a distribution board, change a fuse or attempt a repair. A member of our crew will attend where the booking includes support, or will guide you by telephone where the issue is simple.

12. Loss, Damage and Charges

You are responsible for the equipment from the moment it is delivered or collected until it is counted back in at the yard. Loss or damage beyond fair wear is charged at the reasonable cost of repair or replacement, including any loss of hire while an item is out of service.

Fair wear includes small scuffs, minor marks and the ordinary effect of use in a field. It does not include cuts, burns, staining, bent frames, broken legs, missing parts, water damage caused by leaving equipment uncovered, or damage caused by misuse, neglect or an attempt to repair.

Where an item is missing at the final count, we will tell you in writing and give you a reasonable time to return it before charging for replacement. If the item is later found and returned in good condition, the replacement charge is credited less any reasonable handling cost.

13. Weather and Force Majeure

The Cumbrian weather can change quickly. Marquees and stages are installed to withstand the conditions expected at the site, and the crew will advise if a forecast suggests that conditions will exceed safe limits. Where a structure cannot stand safely, we may need to strike it or postpone the installation.

Neither party is liable for a failure to perform caused by events beyond reasonable control, including severe storm, flooding, snow, restricted access, an order of a public authority or a serious transport disruption. Where such an event affects a booking, we will work with you to move it to another date or to reduce the scope.

Where equipment has already been delivered or erected and an event is curtailed by weather, the hire price remains due. We will not charge for an installation that we cannot safely complete because of conditions on the ground.

14. Liability

Nothing in this agreement excludes or limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot lawfully be excluded. Our liability for other losses is limited to the total hire price paid for the booking concerned.

We are not liable for indirect or consequential loss, including loss of profit, loss of business or loss of opportunity, and we are not liable for loss or damage to property or equipment that you or a third party bring to the site. These exclusions apply to the extent the law allows.

Where the hire includes erection, we are responsible for the work carried out by our crew. You are responsible for how the equipment is used after handover and for the safety of guests and contractors around it. If a third party damages equipment while it is in your care, the cost is recoverable from you under the loss and damage section.

15. Insurance and Risk

We hold insurance for our own operations and for the equipment while it is in our care. We recommend that hirers check that their own event insurance, venue cover or household policy extends to hired equipment and to any loss that could arise from an event they organise.

Risk in the equipment passes to you at delivery or collection and returns to us when it is counted back in. If you collect the equipment yourself, risk passes when it leaves the yard, and you should check that your vehicle and your route are suitable for the load.

Any insurance claim relating to a hire should be reported to us promptly so that our records and our own insurer can be aligned. We will cooperate with a reasonable investigation and provide the documents we hold about the condition of the equipment.

16. Third Party Equipment and Venues

A venue may impose its own rules on load-in times, noise, rigging points, floor protection and the use of power. Those rules apply in addition to these terms. You are responsible for obtaining the venue requirements and passing them to us before the run is planned.

Where equipment from another supplier is used alongside ours, that supplier remains responsible for its own goods. We do not inspect or certify third party equipment, and we will not connect our electrical packs to an installation we cannot see is safe.

If a venue or another contractor damages our equipment, we will deal with you as the hirer and you may recover the cost from the party responsible under your own arrangements.

17. Confidentiality and Media

Information you share about your event, your venue arrangements or your guests is treated as confidential and is used only to deliver the hire or to meet our legal duties. We do not publish customer details or event photographs without permission.

We may take photographs of our own equipment at a site for our records, and occasionally we ask whether an image may be used to show a set-up on this website. Permission is always requested in writing, and it can be refused without any effect on the booking.

If you wish to mention us in event publicity, you may refer to the company by its full name, RED ADMIRAL RENTALS LIMITED, or by the trading name Red Admiral Rentals. You may not suggest that we sponsor or endorse an event unless we have agreed in writing.

18. Privacy and Data

We handle personal information as described in our Privacy Policy, which forms part of these terms by reference and can be read at the privacy link on this website. The policy explains what we collect, why we use it, how long we keep it and how to exercise your rights.

Information submitted through the contact form is handed to your own email application and sent to the address shown on the page. Please do not send sensitive payment details by email. Where a card payment is needed, we will explain the method to use.

Booking records are kept for the period needed to run the hire and to meet accounting obligations. A request to delete information is considered alongside those obligations, and we will explain any part that must be retained.

19. Suspension and Termination

We may suspend or end a hire if the site is unsafe, if access is not as described, if the equipment is being misused, or if payment is overdue. Where that happens we will explain the reason in writing and give you a reasonable chance to correct a problem that can be corrected.

If we end the agreement because of a serious breach by the hirer, any amount already paid may be retained against the work done and the loss caused. If we end it because of a problem on our side, we will refund the unused part of the hire price and, where appropriate, help arrange a replacement.

Ending the agreement does not remove obligations that by their nature survive, including payment for equipment already hired, liability for loss or damage caused before the end, and the confidentiality provisions in these terms.

20. Complaints and Disputes

If something goes wrong during a hire, tell the crew on site and then contact the hire desk in writing as soon as possible. A prompt report lets us put it right and gives us a fair chance to inspect the equipment before it is moved or repaired.

We will acknowledge a written complaint within a few working days, investigate it and reply with our findings. If a meeting would help, we can arrange one at the mill office in Penrith. We aim to resolve matters by agreement rather than through formal proceedings.

If a dispute cannot be resolved by discussion, either party may refer it to the courts as described in the governing law section. Nothing in this section prevents either party from taking urgent action where the law allows it.

21. Governing Law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction over any dispute that cannot be resolved by discussion. Where the law gives a consumer a right to bring proceedings in the courts of the country where that consumer lives, that right is not affected.

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions continue in force. The invalid provision is treated as modified to the minimum extent needed to make it valid, or removed if that is not possible.

A failure to enforce a term on one occasion is not a waiver of the right to enforce it later. A waiver is effective only when it is given in writing by an authorised person at the company.

22. Changes to These Terms

We may update these terms from time to time to reflect changes in the services, the equipment or the law. The current version is published on this page with the date shown at the top.

The terms that apply to a booking are those in force when the booking is confirmed, unless we agree a change in writing and you accept it. A later update does not alter an earlier agreement.

If a change materially affects how a hire is run, we will draw attention to it in the confirmation for any new booking made after the update.
